Publication of the Club des Juristes’ report on judicial price control

On Wednesday 20 October 2021, the Club des juristes published its report entitled ‘Judicial Price Control’, to which Maurice Nussenbaum and Blanche Feauveaux, partners at Sorgem Evaluation, made significant contributions, and in which Pauline Maret, a manager at Sorgem Evaluation, also participated.

This working group, chaired by Maurice Nussenbaum – a financial expert, founding partner and chairman of Sorgem Evaluation, and Professor Emeritus at Paris-Dauphine PSL University – and with Maître Diego de Lammerville, a partner at the law firm Clifford Chance, provided an opportunity for fruitful discussions amongst the working group members.

The report reviews the scope of judicial price review, compares the procedures for such review with the methods used to set prices, and offers a critical analysis.

It sets out recommendations aimed at harmonising the use of assessment criteria, thereby improving the clarity and predictability of court decisions in this area.
