Sorgem Evaluation acted as an expert witness for SNC GE ENERGY PRODUCTS France (SNC GEEPF) in a dispute between the company and the Minister for the Economy, Industry and Digital Affairs.
The Minister for the Economy had requested that SNC GEEPF be penalised, in particular by means of a civil fine under Article L.442-6 III of the Commercial Code, for disrupting economic public order through its wrongful conduct in breach of the provisions of Article L. 442-6 I 2° of the Commercial Code.
He accused the company of imposing obligations on its suppliers that created a significant imbalance in the rights and obligations of the parties, and brought proceedings against it before the Commercial Court of Nancy.
The Commercial Court of Nancy, in a judgment dated 29 June 2018, held that the Minister for the Economy and Finance had no grounds for any of his claims against SNC GEEPF.
